Well drilling reservation terms

Reservation Terms

These terms set out the conditions for reserving construction slots for well drilling work carried out by Nojima Giken (the "Company"). By applying for a reservation, you are deemed to have agreed to these terms.

Article 1 (Application)

These terms apply between the Company and any person who applies to reserve a construction slot for well drilling work with the Company (the "Customer").

Matters not provided for in these terms are governed by the construction contract separately exchanged and by relevant laws and regulations. If the construction contract and these terms differ, the construction contract prevails.

Article 2 (Construction period)

Due to Hokkaido's climate, the standard construction period for well drilling is roughly May to October. We also drill in the winter months from November to around April, but about ¥150,000 (excl. tax) is charged separately for heating and cold-weather measures (reviewed depending on the drilling location). Depending on snow, drilling location and conditions, the start or progress of work may be postponed.

Since on-site work for one job requires about 10 to 14 business days, the number of jobs we can accept in one season is limited. Construction slots are offered in order of reservation.

Article 3 (Formation of a reservation)

A reservation is formed when all of the following are satisfied:

  1. The Company has carried out a preliminary (desk-based) survey and a site survey and judged that drilling is possible
  2. The Company has presented an estimate and the Customer has accepted its contents
  3. The Company and the Customer have exchanged a construction contract
  4. The Customer has transferred the reservation fee to the account designated by the Company, and the Company has confirmed receipt

Contact through the application form, phone or LINE alone does not form a reservation.

Article 4 (Preliminary survey and site survey)

Prior to a reservation, the Company carries out a desk-based preliminary survey based on published boring logs, geological maps, elevation data and the like. No fee is charged for the preliminary survey.

If, as a result of the preliminary survey, the Company judges that drilling is difficult with its equipment and methods, it may decline at that point. No fee is incurred in this case either.

The site survey is carried out to check the drilling location, equipment access route, power and drainage route, and to obtain precise coordinates. The site survey fee is decided after consulting in advance, taking into account the site's location, size, number of visits and other factors.

Article 5 (Reservation fee)

The reservation fee is ¥200,000 (incl. tax).

The reservation fee is applied in full to the construction price. If construction proceeds as reserved, the reservation fee does not become an additional burden on the Customer.

Please transfer the reservation fee to the account designated by the Company within 14 days of the date of the invoice issued by the Company. Transfer fees are borne by the Customer.

If payment cannot be confirmed by the deadline, the Company may put the reservation on hold and offer the construction slot to other customers.

Article 6 (Fixing the start date)

After confirming receipt of the reservation fee, the Company will inform the Customer of the planned start date.

The planned start date may shift due to weather, geological conditions and the Company's other work. If a change arises, the Company will promptly inform the Customer and adjust the schedule.

On-site work requires about 10 to 14 business days, but this does not guarantee consecutive days. The period from the start of work to handover may be longer than this.

Article 7 (Cancellation for the Customer's reasons)

If the Customer cancels a reservation for their own reasons, the reservation fee is handled as follows, based on the date the Company receives the cancellation request.

Time of requestRefund amountRefund timing
Up to 3 months before the planned start dateFull refund (¥200,000)Within 2 months
From 3 months to 1 month before the scheduled start dateRefund minus ¥100,000Within 2 months
Less than 1 month before the scheduled start dateNo refund—

The amount deducted covers our loss from being unable to offer the reserved construction slot to other customers.

Article 8 (Cancellation for Reasons on Our Side)

In any of the following cases, we will refund the full reservation deposit.

  1. When we become unable to perform the work due to equipment failure, staffing or other circumstances on our side
  2. When, as a result of the on-site survey, we determine that drilling is difficult with our equipment and methods
  3. When the reservation can no longer be continued for any other reason attributable to us

In such cases, the refund will be made within 30 days of the date we notify you of the cancellation.

Article 9 (Refund Method)

Refunds are made by bank transfer to the financial institution account you designate. We bear the bank transfer fee.

If you do not designate an account, the refund period will be counted from the date we receive your account details.

Article 10 (Payment for Construction)

The construction price is paid in two installments of 50% of the total each, as follows.

  1. Down payment — 50% of the total construction price (at the time of order; if you reserved work for the following fiscal year or later, the balance after applying the reservation deposit is paid before construction starts)
  2. Balance — 50% of the total construction price plus any additional charges (once water flow is confirmed with a temporary pump)

The down payment covers initial costs such as procuring materials (casing, etc.), transport, drilling work and fuel.

Permanent installation of the casing, pump and inner pipe is carried out continuously after water is confirmed, to prevent the borehole from collapsing.

If drilling does not yield enough water for household use (a pumping rate below 10 liters per minute is the guideline), we will not charge the remaining 50% or additional charges. The work will end with the down payment only.

Whether water will be found cannot be guaranteed in advance due to many factors such as geology and limits on drilling depth. In the event no water is found, the burden is shared between us and the customer.

If you wish to re-drill at a different spot, this will be decided after further discussion.

Article 11 (Scope Without Additional Charges)

Our estimate covers drilling down to the standard depth of 50 meters. Within this range, the estimated price does not change whether the well ends up shallower or reaches 50 meters, and we do not charge extra per meter drilled.

However, the following items are outside the scope of this article and will be estimated and discussed separately.

  1. Drilling beyond 50 meters — If sufficient water is not found at 50 meters and we drill further, we will charge about ¥200,000 to ¥300,000 (varies with geology) for the extra drilling work and materials after the work is complete. The maximum depth our drilling equipment can reach is 70 meters. Whether to continue drilling will be decided with you at that time; we will never drill further without your consent.
  2. Water purification system for drinking — Specifications depend on water quality, so we will provide a separate estimate after water flow and quality are confirmed.
  3. Sand separator — Required when there is a lot of sand. We will provide a separate estimate based on conditions after water is found.
  4. Cold-weather and freeze-protection specifications — Required depending on outdoor installation conditions. These are discussed on site and charged separately (piping below the frost line, freeze-proof hydrants, insulation wrapping, etc.).
  5. Iron and manganese removal equipment and other water treatment equipment
  6. Hand pumps, buildings, pump houses, well cover frames and other ancillary equipment
  7. Supply piping into the house, special piping, electrical work and electrical circuits for the well pump — these may fall within the scope of your house builder or electrician.
  8. Measures required when encountering bedrock, boulders or other strata beyond the capability of our drilling equipment
  9. Price difference if you specify a Japanese-made pump
  10. Additional costs from changes to the work made at your request

Article 12 (Water Flow and Water Quality)

We decide whether drilling is feasible based on preliminary and on-site surveys, but we do not guarantee the presence, quantity, quality or depth of groundwater.

Water quality is judged by testing water sampled after drilling. We do not guarantee water quality before drilling, nor do we finalize the water treatment equipment that may be required.

If you plan to drink the water, you will need to have a water quality test carried out.

Article 13 (Notifications and Laws)

Regulations on groundwater extraction differ by municipality. We check whether any apply during the preliminary survey and report the results to you.

If a notification or permit is required, who carries out the procedure and who bears the cost will be specified individually in the construction contract.

Sewer charges also apply to well water you use, and you are obliged to submit a public sewer usage notification.

Article 14 (Handling of Personal Information)

We use personal information received with your reservation only for the purposes of the preliminary survey, on-site survey, estimate, contract, construction and after-sales service.

Except as required by law, we will not provide it to third parties without your consent. For details, please see our Privacy Policy.

Article 15 (Changes to These Terms)

We may change these terms. Revised terms take effect when posted on our website.

For reservations already concluded, the terms in effect at the time the reservation was concluded apply.

Article 16 (Consultation and Jurisdiction)

Matters not covered by these terms, or questions about their interpretation, will be resolved through good-faith consultation between us and the customer.

If not resolved through consultation, the Sapporo District Court shall have exclusive agreed jurisdiction as the court of first instance.
